Terms of Service

These terms govern the use of pewpew.pt and the purchases and bookings made on it. They replace the old store's terms, which described a WooCommerce platform we no longer use. By using the site you accept what is written here.

1. Who we are

The site is operated by Sequência Janota, Unipessoal, Lda, trading as PEW PEW, with its registered office at Rua do Urjal 48, 3830-173 Ílhavo, Portugal. Contact: [email protected] and +351 969 784 500. Wherever these terms say "we", they mean this company.

2. What the site offers

  • Content: portfolio, news and information about the studio and our production services.
  • Store: merchandise sales.
  • Equipment rental: booking audiovisual gear by the day, with pickup and return at our studio.
  • Customer account: access to your order history and faster checkout.
  • Production services: not bought on the site. They are contracted by proposal and governed by each project's contract.

3. Checkout status

Checkout is closed while we prepare the launch. Until it opens you can browse the catalogue and build a cart, but the request is made by email from the cart itself, and there are no payments on the site.

4. Customer account

An account asks for your name, email and a password of at least 8 characters. You are responsible for keeping your credentials secret and for anything done with your session. The session lasts 7 days and ends when you sign out. We may suspend or close accounts used for fraud, technical abuse or breach of these terms. If you want your account closed, write to us.

5. Prices, VAT and shipping

  • Prices are in euros.
  • Merchandise prices include VAT.
  • Rental prices are shown without VAT, which is added to the total at the statutory rate of 23%.
  • The shipping cost, when you choose shipping, is shown at checkout before you confirm. Pickup at the studio is free.
  • Prices can change at any time, but not after your order is confirmed: the price that applies is the one you saw when you confirmed.
  • If a price is obviously wrong, we may refuse the order and refund whatever you paid, telling you first.

6. How the contract is formed

When you confirm, the site recomputes prices, discounts, VAT and the total on the server from our own catalogue. Your browser does not decide what anything costs. The order gets a reference in the form PW followed by the date and a random code, plus an access code that lets you check its status without an account. The contract is formed when the payment processor confirms payment. We may refuse or cancel an order for unavailability, suspected fraud or manifest error, refunding everything you paid in that case.

7. Payments

Once checkout opens, we accept:

  • Card, through Stripe, on Stripe's own pages;
  • PayPal, approved in the customer's PayPal account;
  • MB WAY, through euPago, approved in the MB WAY app of the number you gave.

At launch, the only active method is card. Methods that are off do not appear at checkout.

Card details are entered at the processor and do not pass through our systems. An order becomes paid when the processor confirms the payment to us, and not before. An MB WAY payment that is not approved leaves the order unpaid and the booking unconfirmed.

8. Merchandise: delivery and pickup

You can choose free pickup at our studio or shipping to the address you give. Risk of loss or damage passes to you on delivery or pickup. If a parcel arrives visibly damaged, tell us by email as soon as possible, with photographs.

9. Equipment rental

We do not ask for a deposit and we do not hold funds on your card. Responsibility for the gear comes from these terms and from the rental agreement, and we ask for an identification document at pickup.

These are the conditions the site applies today, exactly as they are implemented:

  • You choose a pickup date and a return date. Counting is inclusive: picking up on day 1 and returning on day 3 is 3 rental days.
  • The pickup date cannot be earlier than today, and each booking runs to a maximum of 60 days.
  • There is a maximum of 20 units per booking line.
  • The duration discount is automatic, applied to the daily price: 30% from 3 days, 50% from 7 days, 70% from 14 days and 80% from 30 days. This table can be updated, and the one that applies is the one in force when you confirm.
  • The availability shown is stock minus bookings that overlap your date window, computed at that moment. A booking awaiting payment already takes stock. Until payment is confirmed your booking is provisional and availability can change.
  • Pickup and return are at the PEW PEW studio, Rua do Urjal 48, 3830-173 Ílhavo, in the Aveiro area, at the customer's own cost, unless we agree otherwise in writing.
  • Rental is without a crew, unless you contract one separately.
  • From pickup until return the gear is your responsibility, including loss, theft and damage. You return it complete, with accessories, and in the condition you received it, allowing for normal wear.
  • The gear may not be sub-rented, passed to third parties or taken out of the country without our written permission.

10. Production services

Production, directing, live broadcast and studio work are quoted case by case. What governs them is the accepted proposal and the project contract, which prevail over these terms if they differ.

11. Site content and intellectual property

The videos, photographs, text, brand, logo and design of the site are ours or licensed to us, including work made for clients that appears in the portfolio. You may view them and share links. You may not copy, reuse, adapt or commercially exploit this content without our written permission.

12. Acceptable use

You may use the site for what it is for. You may not try to break its security, work around request limits, extract content in bulk by automated means, overload the services, use the payment routes outside the normal flow, or make bookings you do not intend to keep. Sensitive routes have attempt limits and requests beyond them are refused.

13. Site availability

We do our best to keep the site running, but we do not guarantee uninterrupted or error free operation. We may change, suspend or discontinue features and content, including opening and closing checkout. Catalogue, availability and date information may contain errors, which we correct when we spot them.

14. Third party services

The site uses Stripe, PayPal and euPago for payment, Cloudflare for delivery, and CARTO map tiles with OpenStreetMap data on the contacts page. Those services have their own terms and policies, which apply when you interact with them. Links to third party sites do not mean we endorse their content.

15. Liability

We are liable for damage we cause by breaching these terms, within the limits of Portuguese law. We are not liable for lost profits, lost opportunity or indirect damage arising from use of the site, nor for failures of third party services outside our control. Nothing in these terms removes or limits the rights that consumer law gives you.

16. Returns, exchanges and cancellations

These are covered in our refunds and returns policy, which forms part of these terms.

17. Data protection

How we handle your personal data is described in the privacy policy.

18. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you confirmed it. Changes are reflected in the last updated date at the top.

19. Governing law and disputes

Portuguese law applies. In a consumer dispute you can use alternative dispute resolution before going to court, and you can always use the Portuguese electronic complaints book at www.livroreclamacoes.pt.
